Creator Terms & Conditions
These Creator Terms & Conditions (“Terms”) outline the standard requirements, expectations, and obligations for creators collaborating with Mycelium Digital Pte Ltd (“Company”). By agreeing to participate in any campaign, project, or collaboration, the creator (“Creator”) accepts the following Terms.
1. Scope of Work
Creators engaged by the Company may be required to produce and publish content across one or more platforms, including but not limited to Instagram, TikTok, and YouTube. Deliverables, deadlines, and campaign-specific instructions will be communicated separately for each project.
Unless otherwise specified, Creator must adhere to the following Content Guidelines:
- All content must follow the provided brief and brand guidelines.
- Content must be submitted for approval before posting.
- Paid Partnership access, Spark Ads codes, and any relevant publishing permissions must be shared upon posting.
- Screenshot of content performance must be submitted 3 days after the post goes live.
- Payment will only be released within 45 days after the above are completed.
2. Compensation
Creators will receive compensation based on the fee they set on the Company’s platform at the time of accepting the collaboration. Compensation may include:
- A fixed fee, payable via Bank Transfer within 45 days of completing the Content Guidelines above.
- Product gifting or seeding, where applicable.
- Additional bonuses or incentives if explicitly stated.
3. Usage Rights
Unless otherwise stated in the campaign brief:
- The Company may use creator content on its owned social media channels, website, and marketing materials perpetually.
- Any use in paid advertising, boosted posts, or whitelisting requires prior approval and may involve additional compensation, subject to a separate agreement.
4. Exclusivity
Creators may be required to observe a temporary exclusivity period as defined in the campaign-specific brief (e.g., avoiding promotion of direct competitors within the same product category for a stated duration after posting).
5. Disclosure
The Creator agrees to comply with all relevant advertising and disclosure regulations, including:
- Use of clear tags such as #ad, #sponsored, or “Paid Partnership” where required.
6. Revisions
The Company is entitled to request 2 rounds of revisions prior to publishing. Content must adhere to the following timeline unless agreed otherwise:
- Concept + Script: 2 days
- First Draft: 5 days
- Revision: 1–2 days
7. Cancellation
Either party may cancel the Agreement with written notice at least 7 days in advance. The Company can terminate the Agreement if the Creator has breached the contract such as missing the timeline, content does not fulfill the brief, or engaging in any conduct that may harm the advertiser or adversely affect the advertiser’s reputation and image.
8. Confidentiality
The Creator agrees not to disclose any confidential details of the campaign, compensation, or brand strategy without prior written consent.
9. Personal Data Protection
The Creator consents to the collection, use, disclosure, and processing of their personal data by the Company in accordance with the Personal Data Protection Act 2012 of Singapore (“PDPA”).
Personal data may include, but is not limited to, name, contact details, social media handles, payment information, and content performance data. Such data will be collected and used for purposes including:
- Creator onboarding and identity verification
- Campaign management and communication
- Payment processing and accounting
- Performance tracking, reporting, and analytics
- Compliance with legal and regulatory obligations
The Company will take reasonable steps to protect the Creator’s personal data from unauthorized access, use, or disclosure and will retain such data only for as long as necessary to fulfil the purposes stated above or as required by law.
The Creator may request access to or correction of their personal data by contacting the Company through its official communication channels.
10. Governing Law
This Agreement shall be governed by the laws of Singapore.
